
At the complex fact-finding hearing, Alison Easton KC led Anthony Forde for the mother, and Caroline Croft and Srishti Suresh represented the applicant Local Authority.
In order to determine the cause of the child’s serious head injuries, the court had to hear from a range of leading expert witnesses as well as family members and professionals who had been involved with the family.
The Local Authority, represented by Caroline and Srishti, argued that the injuries could not have resulted solely from an accidental fall. Experts agreed these injuries were most consistent with acceleration–deceleration forces, such as shaking.
The local authority successfully proved the majority of the findings that they sought. No threshold findings were made against the mother and shortly after the fact-finding hearing, the child was returned to her mother’s care.
