The Mental Capacity Act 2005 received its Royal Assent on 6 April 2005, yet 15 years later practitioners are still struggling with the basic issue of does P have capacity?

Nick and Alison will look at the statute, the Code of Practice and the recent case law to identify what are the key issues in some of the most common scenarios such as litigation capacity and decisions on residence, care, contact and internet use and the problem of fluctuating capacity.
